The court directed separate trials at Rae Bareli and Lucknow be clubbed and conducted in the capital of Uttar Pradesh only. It also said that the trial judge of Lucknow “shall not be transferred” till conclusion and delivery of judgment in the case.
Senior BJP leader Uma Bharti, who is currently Minister for Water Resources in the Narendra Modi government, will now face trial under new charges of criminal conspiracy. This also raises questions as to whether she will have to resign from her post.
The order came after the CBI pleaded before the apex court, seeking restoration of conspiracy charges against the all accused Advani, Uma Bharti, Murli Manohar Joshi. The CBI had charge-sheeted against Advani and 20 others under Sections 153A (promoting enmity between classes), 153B (imputations, assertions prejudicial to national integration) and 505 (false statements, rumors etc circulated with the intent to cause mutiny or disturb public peace) of the IPC. It had subsequently invoked charges under Section 120B (criminal conspiracy) of the IPC, which was quashed by the special court, whose decision was upheld by the high court.
